Hey, Brian, how long does someone have to sue if they have a birth injury? A birth injury? Well, technically, under Ohio law, a birth injury lawsuit can be brought any time up to the time the child turns 19 years old. Now, it wouldn't be good in most cases to wait if you have an injured child until the child's 19th birthday to file a lawsuit. And there's lots of reasons why that's true. Witnesses may disappear, medical records may disappear. Not to mention the fact that if you can bring the case earlier and get a resolution sooner, the family could use the money to help care for the child all the way up through the child's 19th birthday. So you have until the child's 19th birthday if the injuries to the child. But I would never wait that long. In fact, what I would suggest to anybody whose child has had a birth injury is get the case looked at by a medical malpractice lawyer as soon as possible and then work with the lawyer to figure out the timing of when a suit should be filed. That's what I would tell you in terms of the timing for filing a birth injury case.
